Terms of Service

You must be at least 18 years old to use BKey. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

To use BKey, you must create an account using biometric face verification. You are responsible for:

• Providing accurate and complete information during registration.
• Maintaining the security of your device and biometric credentials.
• All activity that occurs under your account.

You may not create an account on behalf of another person or use another person's biometric data. Each account must correspond to a single, unique individual.

BKey provides a biometric identity platform that allows you to:

• Create a decentralized digital identity (DID) tied to your biometric data.
• Authenticate using face verification instead of passwords.
• Store and manage sensitive data in an encrypted personal vault.
• Approve or deny access requests from third-party applications.

We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

BKey requires biometric face verification to function. By using the Service, you expressly consent to the collection and processing of your biometric data as described in our Privacy Policy. Key points:

• Face scans are processed on your device. Raw images are never stored or transmitted to our servers.
• An encrypted biometric template (a mathematical representation, not a photograph) is derived from each scan.
• You may withdraw consent by deactivating your account, but this will prevent you from using the Service.

You agree not to:

• Use the Service for any unlawful purpose or to facilitate illegal activity.
• Attempt to impersonate another person or create a fraudulent identity.
• Reverse-engineer, decompile, or disassemble any part of the Service or BKey SDK.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Attempt to bypass biometric verification or liveness detection.
• Use automated means (bots, scrapers, etc.) to access or interact with the Service.
• Share, sell, or transfer your account or credentials to another person.

Violation of these rules may result in immediate suspension or termination of your account.

The Service, including all software, design, text, graphics, logos, and trademarks, is the property of BKey Inc. or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. This license does not include the right to:

• Copy, modify, or distribute any part of the Service.
• Use BKey trademarks without prior written consent.
• Create derivative works based on the Service or its underlying technology.

You retain ownership of any personal data you provide to BKey. By using the Service, you grant us a limited license to process your data solely as necessary to operate and improve the Service, as described in our Privacy Policy.

Your encrypted vault data is accessible only to you. BKey cannot read, access, or recover the contents of your vault.

BKey may integrate with or allow access from third-party applications. When you approve a third-party access request:

• You are granting that third party access to the specific data or actions you approve.
• BKey is not responsible for the privacy practices, terms, or conduct of third-party services.
• You can revoke third-party access at any time through the app.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Biometric verification will be 100% accurate in all conditions.
• The Service will meet your specific requirements or expectations.

To the maximum extent permitted by law, BKey Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid to BKey in the 12 months preceding the claim, or (b) $100 USD.

You agree to indemnify and hold harmless BKey Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California. You agree to submit to the personal jurisdiction of such courts.

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. The "Effective date" at the top of this page indicates when these Terms were last revised.
